Terms and conditions

1 – Preamble
The website www.retipalm-shop.ro is the property of SC Symbio Technical & Cosmetics SRL, registered with the Trade Register under no. J40/13092/02.10.2019, VAT Code 41710188, headquartered at Str. SG. Constantin Apostol, no. 2-6, bl. 1, sc. 1, ap. 12, Sector 6, BUCHAREST.

Use (browsing or purchasing) of this site implies acceptance of the terms and conditions found herein.

2 – Definitions

a. Buyer – the individual or legal entity placing an order.
b. Seller – SC Symbio Technical & Cosmetics SRL
c. Goods and Services – any product or service, including documents and services mentioned in the order, to be provided by the Seller to the Buyer.
d. Order – an electronic document acting as communication between the Seller and Buyer through which the Seller agrees to deliver Goods and Services, and the Buyer agrees to receive and pay for them.
e. Contract – an order confirmed by the Seller.

3 – Contract Documents
By placing an electronic order, the Buyer agrees with the communication form (phone or email) through which the Seller operates.

The order will consist of the following documents, in order of priority:

a. The order (including clear details on delivery and billing) and its specific conditions;
b. Buyer’s specifications (where applicable);
c. Terms and Conditions.

Order confirmation by the Seller implies full acceptance of the order’s terms. The Seller’s acceptance is considered final when there is either a verbal (phone) or electronic (email) confirmation to the Buyer, without requiring confirmation of receipt from the latter. An unconfirmed order does not constitute a valid contract.

This contract becomes effective upon order confirmation by the Seller. Confirmation is made via phone or email. The general terms and conditions of sale form the basis of the contract, completed by the warranty certificate issued by the Seller or one of its suppliers.

4 – Seller’s Obligations

a. The information presented on the Seller’s website is for informational purposes and may be changed without notice. Also, for space and structure coherence reasons, product descriptions may be incomplete, but the Seller strives to present the most relevant information so the product may be used as intended;
b. Communication with the store – can be made through interaction, posting opinions on products, or contacting via the details in the “contact” section. The Seller reserves the right to manage the received information without the need to justify decisions.

5 – Copyright

The entire content of the site – images, texts, graphics, symbols, web graphics elements, emails, scripts, programs, and other data – is the property of SC Symbio Technical & Cosmetics SRL and its suppliers and is protected under the Copyright Law (Law no. 8/1996) and intellectual and industrial property laws. Unauthorized use of any of the above elements is punishable under applicable law. The use of the site is allowed only within the limits stated in this document.

6 – Deadlines and Penalties

If delivery and/or order start deadlines cannot be met, the Seller must inform the Buyer of the new estimated delivery completion time.

If the Seller receives incorrect information regarding billing or delivery, a new fulfillment date will be set within 5 working days.

7 – Delivery Methods

When placing an order, you must choose the preferred delivery method. Delivery time within Romania is between 1 and 5 working days, subject to stock availability.

8 – Payment Methods

For customers in Romania, payment is made by cash on delivery. Payment is made in RON, in full, at the time of delivery. Payment is made to the courier, including any shipping costs included in the order total.

9 – Risks and Responsibilities

a. Delivery
The Seller undertakes to ship the Goods and Services via door-to-door courier to the Buyer and via external courier services.

b. Transport – Packaging
Unless otherwise agreed, the Seller transfers risk and responsibility upon handover to the internal courier company or the Buyer’s representative. The Seller ensures proper packaging and the inclusion of all accompanying documents.

10 – Contract Acceptance

Acceptance occurs when the Goods and Services conform to the technical specifications in the Order. If the Buyer finds that the delivered Products or Services do not comply with the specifications, the Seller will remedy this unless external factors prevent it. In that case, the Seller will refund the value paid by the Buyer, if applicable.

11 – Liability

The Seller is not liable for any damages the Buyer or third parties may suffer due to fulfillment of the order or use of Goods and Services post-delivery, especially product loss.

The Seller is liable if subcontractors or partners fail to meet contractual obligations.

12 – Force Majeure

Neither party will be held liable for non-fulfillment of contractual obligations caused by force majeure – unforeseeable events beyond the parties’ control that cannot be avoided.

13 – Governing Law

This document is governed by Romanian law. Any disputes will be resolved amicably or, if not possible, by Romanian courts.

TERMS AND CONDITIONS

♦ The Buyer acknowledges having read all the information displayed on the website www.retipalm-shop.ro for the ordered products (name, price, quantity, etc.) and accepts them without reservation. By placing an order, the client understands they are entering a transaction that involves a payment obligation. Product prices are expressed in RON and include 19% VAT.
♦ To purchase our products, you agree to register and provide real, current, and complete information. If your data is incorrect and cannot be confirmed by phone or email, we reserve the right to cancel the order and block access without prior notice.
♦ Orders not yet shipped can be canceled by sending an email request.
♦ We will respond to written requests within 7 working days, with possible extension depending on the complexity of the request.
♦ Most of our products are in stock. However, a product may appear in stock online but be unavailable in our physical warehouse. The customer will be notified by phone; if paid by card, the amount will be fully refunded.
♦ Descriptions, recommendations, usage instructions, warranties, and product images come from suppliers. www.retipalm-shop.ro is not responsible for any changes or inaccuracies. Suppliers may modify product characteristics without notice. We strive to keep product descriptions updated but cannot guarantee their accuracy or timeliness.
♦ Ordered products must be paid in full, otherwise delivery will not be completed. Payment may be made by card, cash on delivery, or bank transfer. Transactions are in RON only.
♦ An order is considered received if placed on a working day before 5:00 PM. Orders placed after 5:00 PM are considered received the next working day. Orders placed on weekends are considered received on the next working day.
♦ Receipt of the products by the customer represents their acceptance that the products arrived in good condition and match the order in quality. The invoice serves as a sales contract according to Romanian legislation.
